Board of Education, 122 Conn.App. 555 (2010) - In a case of first impression, the CT Appellate Court ruled that a violation of an applicable regulatory scheme is a per se violation of the CT Environmental Protection Act and a per se nuisance and negligence.
Atty Ainsworth Settles 10 Year Wetlands Litigation by Pond Owner Against Regional School District - In Jan. 2011 Shukis v. Board of Education (above) resulted in a settlement of full environmental restoration of a pond adjacent to a District athletic fields construction project plagued by uncontrolled sediments and stormwater runoff along with full costs, fees under CEPA and a substantial six figure settlement.
